HAYATA, LTD. (here after as “HAYATA”) warrants its products to be free from defect in material and workmanship. NO OTHER WARRANTY OF ANY KIND WHATSOEVER, EITHER ORAL OR WRITTEN, INCLUDING IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHER WARRANTY OF QUALITY IS EITHER EXPRESSED OR IMPLIED FOR THE PERFORMANCE OF THIS PRODUCT, EVEN IF HAYATA HAS BEEN NOTIFIED OF THE POTENTIAL OF SUCH A LOSS OR CLAIM. This is HAYATA’S sole warranty and is in lieu of other warranties, expressed or implied, which are hereby excluded, including in particular, all warranties of merchantability or fitness for a particular purpose. HAYATA shall not be liable for any loss, damage or expenses directly or indirectly related to the use of its products or from any other cause or for consequential damages. It is expressly understood that HAYATA and its distributors are not responsible for damage or injury caused to other products, property, or persons, by reason of the use of its products. HAYATA reserves the right to change and/or improve any HAYATA product without notice.

No representative has authority to make any representation, promise or agreement, except as stated herein.

HAYATA products meet agreed specifications according to established tests performed under controlled laboratory conditions and specific test requirements. These tests are not intended to reflect the performance of the product under actual conditions. Performance of this product as a component in a finished product may not necessarily meet the test requirements. Due to the number and variety of applications for which this product may be purchased, HAYATA does not recommend specific application or product designs or assume responsibility for use results obtained or suitability for specific applications. No statement contained herein shall be construed as a license to operate, or as an endorsement of products of specific applications. Representations by any person of performance data other than as set forth herein or otherwise in writing by HAYATA are unauthorized and are utilized at customer’s risk.

Prices are subject to change without notice and all such items will be billed at prices in effect at the time of shipment.
